TERMS OF USE

Last updated: October 2, 2026

Welcome to SHIVA Beyond Sound.

By creating an account, purchasing a product, joining SHIVA Membership, or accessing our website and educational content, you agree to these Terms of Use.

1. SHIVA MEMBERSHIP

SHIVA Membership is an online violin learning membership that may include sheet music, SHIVA Original Arrangements, SHIVA Performance Editions, practice videos, educational materials, live mentoring calls, community access, and other resources.

The content available within the membership may grow, change, or be updated over time.

Some membership content may become available gradually according to a scheduled release or drip schedule.

2. SUBSCRIPTION AND AUTOMATIC RENEWAL

SHIVA Membership is offered as a recurring subscription.

By purchasing a monthly or annual subscription, you authorize the applicable payment provider to charge the subscription fee automatically at the beginning of each new billing period until you cancel your subscription.

Your subscription price and billing frequency are shown at checkout before purchase.

Unless otherwise stated, cancellation prevents future renewal charges. Access generally continues until the end of the period already paid for, subject to applicable law and the rules of the payment platform.

3. CANCELLATION

You may cancel your subscription through the account and billing options available on the platform.

After cancellation, you will not be charged for subsequent billing periods. Your membership access will end according to the applicable paid subscription period and platform settings.

Cancellation is different from exercising a statutory right of withdrawal.

4. EU CONSUMER RIGHT OF WITHDRAWAL

If you are a consumer located in the European Union, you may have the legal right to withdraw from your initial subscription contract within 14 days of purchase without giving a reason, subject to applicable law.

Eligible customers can exercise this right using the withdrawal function available on the billing page of their SHIVA Beyond Sound account.

When a valid withdrawal is exercised, any refund due will be processed in accordance with applicable law, generally using the original payment method.

The statutory right of withdrawal is separate from ordinary subscription cancellation and applies according to applicable consumer law.

5. REFUND POLICY

Except where a refund or withdrawal right is required by applicable law, payments for SHIVA Membership and other digital products are generally non-refundable once access to the purchased digital content or membership has been provided.

This policy does not limit any mandatory consumer rights or remedies that cannot legally be excluded.

If you believe that you have been charged incorrectly or experience a technical problem preventing you from accessing content you purchased, please contact us so that we can investigate the issue.

6. DIGITAL CONTENT AND EDUCATIONAL PURPOSE

Our sheet music, videos, mentoring, practice guidance, and other materials are provided for educational purposes.

Individual results depend on many factors, including practice, experience, participation, and personal circumstances. We do not guarantee any particular performance, audition, educational, or professional result.

7. INTELLECTUAL PROPERTY

Unless otherwise stated, SHIVA Beyond Sound owns or controls the rights to the original educational materials, arrangements, editions, videos, graphics, teaching resources, and other original content provided through our services.

Your purchase or membership gives you a limited, personal, non-exclusive, non-transferable right to access and use the materials for your own personal educational use.

You may not, without permission:

• redistribute or resell our sheet music or PDFs

• upload our materials to other websites, groups, platforms, or file-sharing services

• share your membership access with another person

• reproduce or distribute our videos or educational materials

• commercially exploit, copy, or redistribute membership content

Copyright in underlying musical works remains with the relevant rights holders where applicable.

8. ACCOUNT SECURITY

Your account is personal to you. You are responsible for maintaining the confidentiality of your login information.

You may not share your account credentials or provide unauthorized access to membership content to other people.

We reserve the right to restrict or terminate access where there is evidence of unauthorized sharing, redistribution, fraud, or serious misuse of our services.

9. LIVE MENTORING AND COMMUNITY PARTICIPATION

Live mentoring calls and community spaces are intended to provide a respectful and supportive learning environment.

Members must communicate respectfully and must not harass other participants, distribute inappropriate material, or misuse private information shared by other members.

We may remove participants from community spaces or live sessions in cases of serious or repeated inappropriate conduct.

10. AVAILABILITY AND CHANGES TO CONTENT

We aim to provide and continually develop the resources described as part of SHIVA Membership.

Individual materials, live session schedules, teachers, features, or platform functionality may occasionally change where reasonably necessary.

Nothing in this section limits rights that consumers may have under mandatory applicable law where a digital service does not conform to the contract.

11. THIRD-PARTY SERVICES

Our services may use third-party platforms, including Thinkific and other services used for payments, video meetings, communications, or community features.

Use of those services may also be subject to the applicable provider’s terms and privacy policies.

12. TERMINATION FOR MISUSE

We may suspend or terminate access in cases of fraud, unauthorized redistribution of copyrighted materials, account sharing, harassment, or other serious violations of these Terms.

Any action taken under this section remains subject to applicable consumer law.

13. CHANGES TO THESE TERMS

We may update these Terms when reasonably necessary to reflect changes to our services, platform, or legal obligations.

Where required by applicable law, material changes will be communicated appropriately and will not limit mandatory consumer rights.

14. GOVERNING LAW

These Terms are governed by the applicable laws of the Republic of Croatia, without depriving consumers of mandatory protections available to them under applicable consumer law.
